1. Preliminary note and object of terms and conditions:
The business activity´s object is the production and distribution of music CD´s for public performance at aerobics- and sportevents. The Purchase of these CD`s is just permitted for coaches of aerobics, sports clubs, gyms, etc; a general private use respectively the purchase through consumers is not possible.
2. Orders and prices:
The CD´s that are shown in the web-shop and other advertising material provide exclusively information and are not ment to be offers in the legal sense.
All mentioned prices include the value added tax (VAT).
3. Guarantee:
The guarantee for CD`s from GYMusic lasts 1 year starting with the invoice. In case of justifiable customer complaint during this period of time, GYMusic will compensate the CD. If the delivery of a compensation should fail, GYMusic will repay the selling price. Exceeding claims are excluded.
4. Return debit notes:
Should the automatic debit transfer system fail without the fault of GYMusic, the customer will be charged for the costs resulting from the return debit notes.
5. Delay of payment:
All bills have to be payed net immediatly, except it exists an explicit agreement for a later term of payment. In case of delay of payment of a later term of payment that had been arranged before, the customer will be charged with a dunning charge of 3,00 €. Should the customer miss to pay the bill after receiving the first dunning, he will be charged with 6,00 €. After ignoring the second dunning, the claim for money will be passed to a encashment company.
6. Exchange/return
An exchange respectively a return is possible within 14 days, as far as the CD is not opened or used and if there aren`t any signs of use. Used CD`s are excluded from exchange, unless it exists an other agreement. CD`s of a subscription that were used for just one time can be returned within 14 days after invoice.
